Terms and Conditions of Use
Streaming Platform · Rental-Only Model · 96-Hour Access Window
Version 1.0 | As of: June 2026
These Terms and Conditions of Use govern the use of our streaming platform.
Please read them carefully before renting any content. By completing a rental
transaction, you agree to these Terms and Conditions.
§ 1 Scope & Contracting Parties
These Terms and Conditions of Use (hereinafter "T&C") apply to the use of the
streaming platform (hereinafter "Platform") and all associated services provided
by the operator.
1.1 Contracting Parties
The usage agreement is entered into between the operator of the Platform
(hereinafter "Provider") and the natural or legal person who registers on the
Platform (hereinafter "User").
1.2 Scope of Application
These T&C apply exclusively. Conflicting or deviating terms and conditions of the
User shall not be recognised unless the Provider expressly agrees to their
validity in writing.
1.3 Amendments to the T&C
The Provider reserves the right to amend these T&C at any time with effect for
the future. Users will be notified of any changes by email at least four weeks
before they take effect. If the User does not object to the changes within four
weeks of receiving the notification, the amended T&C shall be deemed accepted.
§ 2 Service Description
The Platform exclusively offers the time-limited rental of audiovisual content
(films, series, documentaries, etc.). A permanent purchase of content is not
available.
Key features:
• 96-hour access window
• No purchase available
• Streaming only
2.1 Nature of the Service
The Provider makes content available to the User for streaming. Downloading
content to local devices is only permitted where the Platform expressly offers a
corresponding offline feature.
2.2 Availability
The Provider aims for Platform availability of 99% on an annual average. Excluded
from this are scheduled maintenance works, which will be announced outside peak
usage hours where possible, as well as unavoidable technical disruptions.
2.3 Content Changes
The Provider is entitled to modify, expand, or reduce the content catalogue at
any time. Rental periods already booked and not yet expired shall not be affected
by content changes.
§ 3 Registration & User Account
3.1 Prerequisites
Use of the Platform requires prior registration. Registration is available
exclusively to natural persons who have reached the age of 18 and to legal
entities.
3.2 Registration Details
Complete and accurate information must be provided during registration. The User
is obliged to keep their data current and to update any changes in their user
account without delay.
3.3 Login Credentials
The User is obliged to keep their login credentials (in particular their password)
confidential and not to make them accessible to unauthorised third parties. In the
event of suspected misuse, the Provider must be notified immediately.
3.4 Account Ownership
The user account is non-transferable. Shared use of a single account by multiple
persons is not permitted unless a corresponding family plan has been booked.
§ 4 Rental Terms & Access Window
IMPORTANT: The access window is 96 hours (4 days) from the time the content is
first played. After this period, access to the content is no longer possible
without initiating a new rental.
4.1 Start of the Access Window
The 96-hour access window begins when the rented content is played for the first
time. Prior to the first playback, the rental right expires after 30 days from
the booking date (availability window) if the content has not been started.
| Period | Description |
|---|
| 30 days from booking | Availability window — content can be started for the first time within this period |
| 96 hours from first playback | Access window — content may be played back as many times as desired |
| After expiry | Access lapses; re-rental at the regular fee is possible |
4.2 Multiple Playbacks
Within the 96-hour access window, content may be played back as many times as
desired and on all of the User's linked devices, provided that the simultaneous
streams limit (generally 2 concurrent streams) is not exceeded.
4.3 No Entitlement to Extension
There is no entitlement to an extension of the access window unless the
unavailability is attributable to a fault on the part of the Provider.
4.4 Technical Interruptions
If access is interrupted by a technical fault attributable to the Provider for
more than two consecutive hours, the access window will be extended by the
corresponding interruption period, provided that the User reports the fault to
the Provider within 48 hours of its occurrence.
§ 5 Prices & Payment Terms
5.1 Prices
The rental prices in force at any given time are displayed on the Platform and
are stated as final prices inclusive of applicable VAT. Price changes shall apply
from the time of their publication on the Platform for new rental transactions.
5.2 Due Date
The rental fee is due in advance upon completion of the booking. Content will be
made available immediately upon receipt of payment.
5.3 Payment Methods
The Provider accepts the payment methods displayed on the Platform. The User
authorises the Provider to collect the amounts due from the designated payment
source.
5.4 Payment Default
In the event of payment default, the Provider is entitled to suspend the User's
access to the Platform until all outstanding amounts have been settled in full.
§ 6 Right of Withdrawal
6.1 No Right of Withdrawal After Commencement of Performance
The right of withdrawal lapses for contracts for the supply of digital content
where the Provider has begun performance and the User, at the time performance
commenced, expressly agreed that the Provider would begin performance before the
expiry of the withdrawal period and confirmed that they would thereby lose their
right of withdrawal (pursuant to applicable consumer protection legislation).
6.2 Withdrawal Notice
Consumers are generally entitled to a 14-day right of withdrawal. However, this
right lapses upon the User starting the content, provided the User has expressly
consented to early performance and the associated lapse of the right of
withdrawal. Such consent is obtained for each rental transaction.
6.3 Refunds
Where content has not yet been started and the 30-day availability window has not
yet expired, the User may request a refund within 14 days of the booking date.
§ 7 Technical Requirements
7.1 System Requirements
A stable internet connection and a compatible end device are required to use the
Platform. Current system requirements are available in the Platform's help
documentation.
7.2 DRM Technology
Recognised Digital Rights Management (DRM) systems are used to protect content.
The User agrees that DRM software components necessary for playback may be
installed or activated on their end device.
7.3 Internet Connection
The User is responsible for providing, at their own cost, an internet connection
sufficient for uninterrupted playback. The Provider accepts no responsibility for
quality limitations arising from insufficient bandwidth.
§ 8 Copyright & Usage Rights
8.1 Scope of Usage Rights
Upon completing a rental, the User is granted a non-exclusive, non-transferable
right, limited to 96 hours, to use the content solely for private,
non-commercial purposes.
8.2 Prohibited Actions
The User is expressly prohibited from:
• Copying, downloading, or saving content (except via an officially offered
offline feature)
• Sharing, selling, renting out, or publicly exhibiting content to third parties
• Circumventing, disabling, or manipulating DRM protection measures
• Using or distributing content in any edited or derivative form
• Creating screen recordings or any other type of capture of content
8.3 Third-Party Rights
All content on the Platform is protected by copyright. All rights remain with
the respective rights holders. The User's usage rights are limited to the extent
described in § 8.1.§ 9 User Obligations
9.1 General Obligations
The User undertakes to use the Platform solely in accordance with these T&C and
applicable law.
9.2 Prohibited Conduct
The User must not use the Platform to:
• Interfere with other users' access to or enjoyment of the Platform
• Deploy automated access tools or scraping methods
• Circumvent or probe the Platform's security mechanisms
• Create false identities or multiple accounts
9.3 Reporting Obligation
The User is obliged to report any security vulnerabilities, instances of misuse,
or violations of these T&C to the Provider without delay.
§ 10 Liability & Warranty
10.1 Provider's Limitation of Liability
The Provider is liable without limitation for damages caused intentionally or
through gross negligence, as well as for damages resulting from injury to life,
body, or health. In all other respects, the Provider's liability is limited to
foreseeable, typical contractual damages.
10.2 Exclusion of Liability
The Provider accepts no liability for:
• Streaming interruptions or quality degradation resulting from the User's
insufficient internet connection
• Incompatibility with unsupported end devices or operating systems
• Data losses not attributable to the Provider's fault
• Damages caused by third-party software on the User's end device
10.3 Warranty for Defects
If rented content cannot be accessed, or can only be accessed in a limited
manner, due to a fault attributable to the Provider, the User is entitled to
remediation. If remediation fails or is unreasonable, the User is entitled to a
refund of the rental fee.§ 11 Data Protection
The collection, processing, and use of personal data is carried out exclusively
in accordance with applicable data protection law, in particular the General Data
Protection Regulation (GDPR) and the German Federal Data Protection Act (BDSG).
Further details are set out in the separate Privacy Policy, which forms part of
these T&C and is available on the Platform at all times.
11.1 Usage Data
The Provider collects and processes usage data (e.g. viewing history, device IDs,
payment information) for the performance of the contract, to improve the service,
and — with the User's express consent — for marketing purposes.
11.2 Right of Access
The User has the right to access their stored data and to request rectification,
erasure, and restriction of processing under the conditions set out in the GDPR.
Requests may be directed to the Provider's data protection contact.
§ 12 Termination & Suspension
12.1 Termination by the User
The User may terminate their user account at any time without notice. Rental
periods already booked and still active shall remain unaffected by termination
until their regular expiry. A pro-rata refund for content not yet started will
be issued in accordance with applicable law.
12.2 Termination by the Provider
The Provider is entitled to terminate the user account with 30 days' notice.
The right to extraordinary termination for good cause remains unaffected. Good
cause exists in particular in cases of:
• Violations of these T&C, in particular §§ 8 and 9
• Chargebacks or payment failures without legitimate justification
• Attempts to manipulate DRM systems
12.3 Suspension
In the event of reasonable suspicion of a violation of these T&C, the Provider
is entitled to temporarily suspend the account and give the User an opportunity
to respond.
§ 13 Final Provisions
13.1 Governing Law
The law of the Federal Republic of Germany shall apply, to the exclusion of the
UN Convention on Contracts for the International Sale of Goods (CISG). For
consumer contracts, the mandatory consumer protection provisions of the country
in which the consumer is habitually resident shall apply.
13.2 Jurisdiction
The place of jurisdiction for all disputes arising from and in connection with
this contract shall be, to the extent permitted by law, the registered seat of
the Provider. For consumers, the statutory place of jurisdiction shall apply.
13.3 Dispute Resolution
The European Commission provides a platform for online dispute resolution (ODR)
at https://ec.europa.eu/consumers/odr. The Provider is neither obliged nor
willing to participate in dispute resolution proceedings before a consumer
arbitration board.
13.4 Severability Clause
Should any provision of these T&C be or become wholly or partially invalid or
unenforceable, the validity of the remaining provisions shall not be affected.
In place of the invalid or unenforceable provision, the valid and enforceable
provision that most closely reflects the economic intent of the invalid or
unenforceable provision shall be deemed agreed.
13.5 Entire Agreement
These T&C, together with the Privacy Policy and Legal Notice, constitute the
entire agreement between the Provider and the User regarding use of the Platform
and supersede all prior agreements and understandings.
